                                                                  DAY 213

                                            SEMIR KHAZNA, Cross-examined:

MR. JUSTICE BELL: Can we pause a moment? What is "Heathrow
       FS"?
       A. Sorry, "free standing". It is for the drive-thru; we
       call it "free standing".

  Q. I see. Is it possible that the people on the list, "the
following rate changes were proposed during the pay period"
are all people who are going to work at Feltham, because
they are very nearly all starters. Only two of those who
are not starters are on the basic rate of 3.15. The others
get with or without an increase somewhere between 3.25 is
the lowest, and I think the person who has gone up to 4.50,
gone up 50p to 4.50, is the highest and he is occupation
       code is 7.
       A. Occupation code 7 could be a Floor Manager.

  Q. Yes. I wondered whether that was so because people who are
designated as Floor Managers in answer to another question
were 7. I cannot remember now whether it was Mr. Plaister
who was training squad was a 2; or can you just not help on
       that?
       A. Sorry, why this person got the -----

  Q. I appreciate people who start probably do, pretty quickly,
appear on the list of people eligible for rate changes
because they may very well get one at the end of their
       probationary period anyway?
       A. That is correct.

  Q. So I can see that at any given time there may be a high
proportion of starters but they are very nearly all
starters on that. Can you just not help me in relation to
       that?
       A. The bulk of them are -- there are about 34, as we said,
on 3.50, the new starters, and it looks like most of them
are on 3.50 when they started and they probably have not
even been in the restaurant for over a month, so -- or some
not even completed their probationary period. By that time
they would have been transferred over to Feltham.

  Q. There we are. It is probably a complete red herring,
       anyway. Yes?

MS. STEEL: Did you say you thought the Feltham store opened on
       the 4th April?
       A. I know it was a Good Friday. I think it was the 4th.
I do not -- but it was a Friday that we opened up; Good
       Friday.

  Q. Right. On the 24th April of these 31 people, on the
payroll summary that is for the 24th April to the 7th May?
       A. Sorry, which page are you looking at?

  Q. The relevant page is on page 44. Of those 34, 26 are still
on the Heathrow payroll. Do you know why that would be?
       A. Which one are you referring to? I have page 44 but to
which page prior to that are you referring to? 34?

  Q. Yes. Of the people who started who are shown on pages 34
