DAY 213
SEMIR KHAZNA, Cross-examined:
scheduling is not working in that store?
A. Sorry, can you -----

Q. Well, if people are not being scheduled more than what they
should be scheduled, which in terms of, say, full-timers is
39 hours?
A. That is correct.

Q. The excess hours sheet, the more names on that in general,
would point to the scheduling is not being done properly or
the store is understaffed?
A. Well, there can -- there are scheduling, they are doing
the schedule, but if crew have worked excess hours, that
would not be initially shown on the schedule.

Q. That is correct.

MR. JUSTICE BELL: No, but what I think Mr. Morris is saying is
that people are not scheduled excess hours, they are
scheduled up to the number of hours they should be doing.
A. That is correct.

Q. 39 if they are full-time, for instance. If, despite
scheduling them that way, excess hours crop up on the
excess hours print-out against their name, is that an
indication, Mr. Morris is asking you, of understaffing too?
A. Yes, it is.

MR. MORRIS: Right. OK. The very last question is you say in
paragraph 11 about burns: "Accidents do happen from time
to time. They generally occur to a genuine accident or due
to a lack of concentration". Are you saying that lack of
concentration is not a genuine accident?
A. The lack of concentration could be not concentrating on
your work, talking to somebody else next to you.

Q. It is still a genuine accident, if someone burns
themselves?
A. If someone burns themselves, yes, it is still -----

Q. You would take it seriously?
A. Yes, it would be recorded.

Q. You do not just blame the worker for ---
A. No.

Q. -- right -- not concentrating?
A. No.

Q. Thank you. No further questions.

MR. RAMPTON: Your Honour, I really would hope ------

MR. MORRIS: Sorry, there may be one other question, sorry.
Carry on.

MR. RAMPTON: Your Honour, I really would like to finish
Mr. Khazna, if I may, this afternoon. I have only one
question ---
