DAY 213
I suggest. Do not for the moment put her off from -- it is
next Friday, is it not?

MR. RAMPTON: Yes.

MR. JUSTICE BELL: But we will take stock when there is further
information.

What is being canvassed is the possibility -- I say no more
at this stage -- that Mr. Bone's statement may be
admissible under the provisions of the Civil Evidence Act;
that instead of him giving evidence next Thursday, that
statement is taken as read under the Civil Evidence Act;
and, on the basis that that evidence is admissible in its
paper form, although Mr. Bone has not given evidence from
the witness box, we then go to Miss Hovey for you to ask
her further questions in chief, if you wish, and then for
Mr. Rampton to cross-examine. But I am not asking you for
any reaction at this stage, or any argument. The news has
obviously just come through, so everyone should have time
to ponder it further.

But do not take Miss Hovey out for next week, because that
is real possibility -- and I say no more than that -- that
that is the way the matter may be dealt with. 10.30
tomorrow.
