     2        working there that have actually been taken off the payroll
     3        system.

     5   Q.   Have you ever kept names on the payroll so as to
     6        artificially inflate the number of crew nominally on the
     7        payroll?
     8        A.  No, I have no need to.

    10   Q.   One other thing about those payroll sheets -- it is the
    11        last thing I want to ask you at the moment; it is something
    12        that the Defendants raised yesterday or the day before --
    13        one notices a Mr. Patil, whose initial is "D", who seems to
    14        work a very large number of premium hours and virtually no
    15        other hours during the course of the day.  Do you remember
    16        him?
    17        A.  Yes, I do, yes.

    19   Q.   What was his first name?
    20        A.  I think his name was Danti, but he was called Palli.

    23        A.  I think his actual real name was D-A-N-T-I, but he was
    24        called Palli.

    26   Q.   What was the reason why he worked all those premium hours?
    27        A.  The premium hours are paid from 11 o'clock at night
    28        until 7 o'clock in the morning.  He was actually -- he
    29        worked overnight.  We had special cleaners who come in just
    30        to clean the restaurant at night, and he was one of those.
    31        He did not work at any other time, so he would be paid a
    32        few regular hours if he clocked in on the evening rate, and
    33        maybe as he worked over in the morning the rest of it would
    34        be all premium hours.

    36   Q.   Was there a regular team of night cleaners?
    37        A.  Yes, there was.  There was a team of about four --
    38        I think it was five people; three of them were full-time
    39        employees and two were part-time and only worked a couple
    40        of days.

    42   Q.   How many days a week do the three full-time night cleaners
    43        do?
    44        A.  They would have worked five nights or four nights,
    45        depending on what they were scheduled, but usually it would
    46        have been five nights.

    48   Q.   When would the two part-time night cleaners work?
    49        A.  They were at the weekends.
