                                                                  DAY 214

                                                 DAVID ROBERTS, Examined:

  Q. Some of which come, about half of it, when you were the
       Manager?
       A. That is correct.

  Q. Have you an explanation why that gap appears there with no
entries at all for seven months?
       A. There would -- I do not know for a fact, but I would
assume that there was more than one book available at the
time. We did use to keep all the books in none drawer
because of restrictions on space. I can only assume that
somebody was entering it in another book.

  Q. Can we assume that you are not proposing that there were no
accidents during that seven month period?
       A. I would find it hard to believe if there was no minor
       accidents.

  Q. You have been through Mr. Beech's original statement?
       A. Yes, I have.

  Q. You dealt with that in your own statement. In a moment we
are going to go through his new allegations, but before
I do that I want to ask you first if you have a clear
       memory of him?
       A. I do remember him, yes.

  Q. This is during your time. He worked for you, I think,
roughly about three months, so far as we can tell. If you
can remember, what times of day he would usually do his
       shifts?
       A. I recall he worked from 12.00 until 10.00, from noon
until 10 o'clock in the evening.

  Q. Again, this is rough -- I have the figures here, but
I would like to ask you for your memory first -- do you
remember roughly how many shifts he would do in a week
       while you were the Manager?
       A. It was usually two shifts a week.

  Q. What length of shifts?
       A. 10 hours.

  Q. 10 hours. My Lord, what I have done -- this is, of course,
subject to correction by anybody else who has done the
figures -- is to make a table showing the number of hours
Mr. Beech worked in each fortnight from when he began on
7th November through to the last fortnight that he worked
ending 24th September 1994. I put in the total number of
hours which I have converted from decimals into hours and
minutes and the number of premium hours during each of
those fortnights. I would just like to ask Mr. Roberts one
       or two questions.

MR. JUSTICE BELL: Let us have a -----

MR. RAMPTON: Would your Lordship like to see it?

MR. JUSTICE BELL: I think everyone should have time to look at
       it first.
