     2   Q.   Where would the breakfast be cooked, if we look at this
     3        plan?
     4        A.  Where it says "flat grill", if you look in the middle
     5        of it, there is one place that says "flat grill"; it says
     6        "flat", and then next to it it says "prep table".  There
     7        was actually a grill there; there was not a prep table
     8        there.

    10   Q.   I think I am bound to say, Mr. Roberts, from looking at it,
    11        this is a plan done in anticipation of the restaurant
    12        built.  Do you happen to know when this restaurant opened?
    13        A.  I do not know.

    15   Q.   This plan is dated January 1991.  It is not a scale drawing
    16        of the place as is or was.  One can tell that from looking
    17        at the signs.  In fact, in use, that was a grill and not a
    18        prep table?
    19        A.  It was actually a grill, yes.  There was breakfast
    20        cooked on those two, and the one that says "flat", opposite
    21        that, that is where the sausage was cooked.

    23   Q.   So that is not a squashed down thing at all?
    24        A.  The flat one is just a basic flat grill.  It was just
    25        used for cooking eggs, because you did not need heat from
    26        the top for the eggs.

    28   Q.   Where was the sausage done?
    29        A.  The sausage was cooked opposite where it says "flat",
    30        which was a clam shell grill.

    35        A.  Up, directly north of "flat".

    37   Q.   Clam shell and griddle; is that right?
    38        A.  Yes.

    41        A.  It is just a word for grill.

    45   MR. JUSTICE BELL:  Should we read that all as one phrase, clam
    46        shell griddle?
    47        A.  Clam shell griddle, or clam shell grill; it is the same
    48        terminology.

    55        table", you see what look like four little jars, as they
    56        are drawn.  On the left hand two, it has "clam shell
    57        griddle" and on the right hand two it has "clam shell
    58        griddle".  It is not clam shell.  (To the witness) There
    59        are four of them there, are there?
    60        A.  There are two.  The grill itself is -- if you imagine
