                                                                  DAY 214

                                                 DAVID ROBERTS, Examined:

1 wrap and call. Obviously, if there is a Manager working
2 there, they may have to do it at some point in their shift.
     3
4 Q. Somebody else would then replace them on the wrap and call?
     5 A. Yes.
     6
7 Q. E, at the bottom of the page, "Scheduling": "If you did not
8 play the game and be 'cooperative' with what Managers
9 asked, you could be penalised" -- I think the word is, not
10 "punished", as I read it the other day -- "with the worst
11 jobs or low hours." Does that ring any bells with you?
12 A. I do not recall playing any games with the schedule.
    13
14 Q. Do you ever recall either having done or having asked
15 somebody else to do this, saying to a crew member: "If you
16 do not work on this evening, tomorrow you will get the
17 lavatory cleaning or even get less hours than you have
    18 asked for"?
19 A. No, I have never said it.
    20
21 Q. I think that is all from me. Thank you, Mr. Roberts.
22 Thank you very much. (Pause) Sorry. Mrs. Brinley-Codd
23 reminds me there is one more thing. I am sorry, it is
24 because I did not look at the last page of Mr. Beech's
    25 statement.
    26
27 At the top, he says, at F*: "When he left it was a huge
28 relief." Do you see that?
    29 A. Yes, I do.
    30
31 Q. Did you interview Mr. Beech when he left?
32 A. I spoke to him when he told me he was leaving, yes.
    33
    34   Q.   What is was the nature of your conversation; what happened;
    35 what was said?
36 A. At that time, there was quite a few people who were
37 leaving to return to college; and, because of the crew
38 situation as it had been, I made a point of speaking to
39 those people, asking them if they would be returning in
40 December. Obviously, at that time, I did not know what the
41 crew situation in December would be like.
    42
    43 Q. For December?
44 A. For December, yes. I was still relatively new to the
45 restaurant, so I wanted to make sure we would have enough
46 people further down the line; and I asked him if he would
47 be coming back in December.
    48
49 Q. What did he say?
    50 A. "Yes".
    51
52 Q. He said "yes". I mention, Mr. Roberts, because it is
53 convenient to do it now, his leaving code was 7, which
54 I think is mutually agreed?
    55 A. That is correct.
    56
57 MR. RAMPTON: Yes, thank you.
    58
    59
60 MS. STEEL: Where do you find the leaving code 7?

                                      27
