                                                                  DAY 214

                                                 DAVID ROBERTS, Examined:

MR. RAMPTON: I found that in the Lynne Mead documents.

MS. STEEL: But I meant for Mr. Beech.

  MR. RAMPTON: Somebody told me.

MR. MORRIS: Bit of a leading question, then, is it not?

MR. JUSTICE BELL: Well, it is. It is evidence.
(To the witness) Do you know what his leaving code was?
       A. Yes, I do. It was 7.

MR. JUSTICE BELL: That is secondary evidence, is it not, if it
       has gone on a form?

MR. RAMPTON: Secondary -- without the form?

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: It may be secondary evidence. If I can find the
       form with it on -----

MR. JUSTICE BELL: In fact, it does not add anything, because it
       clearly was mutually agreed.

MR. RAMPTON: I think so, yes.

MR. JUSTICE BELL: There is more detail.

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: I only say it because I am terribly
apprehensive, with all the fuss we have had about discovery
in this case, that information comes in without the
       document. But there we are.

MR. MORRIS: If we can just comment on that? There has been an
enormous amount of evidence, or supposed evidence, based
upon or that could be verified or checked with the clock
cards from the store; and we have not actually made an
application for the clock cards at this stage. But -----

MR. JUSTICE BELL: Try and forbear from doing it where we have
got quite a lot of oral evidence on each side. You
       obviously have done so far.

MR. MORRIS: It is just that it should really have been
disclosed, or at least some relevant samples or something.

MR. JUSTICE BELL: Now, has anything occurred this morning, for
instance, like the schedule Mr. Rampton used -- I am not
suggesting you check that through now -- which you must
take instructions on before the midday adjournment?

MR. MORRIS: I do not think so.

  MR. JUSTICE BELL: Fair enough.
