                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

       A. Not as I remember, no.

  Q. So he is wrong about that?
       A. In respect of me, because he had another way of doing
       it.

MR. JUSTICE BELL: Which was? I think you have said, but -----
       A. He used to come into the restaurant and count the crew
on the actual physical schedule, how many people had hours
       and were working.

MS. STEEL: But the people on the schedule would not tell him
how many people were on the payroll, would it?

MR. JUSTICE BELL: Would it not? Did you not have them all
down, and some would be scheduled to work and, presumably,
       others were not?
       A. No.

  Q. Were they all down one side of the schedule or did the
schedule for the fortnight only have the ones who were
going to work in that fortnight?
       A. It would have everybody who was working. It may even,
for example, have four people written on there, their
names, but if they were on holiday or study leave, it would
have that written on there. But every single working
person would be on there, regardless of whether they were
       working that week.

  Q. That should be everyone on the payroll, then?
       A. That is correct, yes.

MS. STEEL: The figure that he gave in his statement -- I do not
know whether you want to refer to it; do you want me to
       refer you to it?

MR. MORRIS: Can you clarify that there are 170 names on the
       schedule?
       A. Yes.

MS. STEEL: If you get his statement -- it should be in the
same bundle as your statement. I am afraid I do not know
       what tab.

MR. JUSTICE BELL: It is J.
       A. Yes, I have got it.

MS. STEEL: Actually, if you turn to page 4 of that, in the
bottom part of paragraph 8, which actually starts on the
previous page, the relevant part is that he says: "In
December 1994 there were six Managers, 12 Floor Managers at
the restaurant and the number of crew on the payroll had
increased to around 160." Yesterday, I think he said that
you told him that, yes; that is right, is it not?
       A. That is the number that is taken off the payroll
       report.

  Q. And you gave him that information?
       A. Yes.
