                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

  MS. STEEL: Yes.

MR. JUSTICE BELL: Do we have figures for the turnover or
anything of that? We do not.

MS. STEEL: Do you know actually what the labour costs were in
       pounds terms?
       A. No.

  Q. You do not.

MR. MORRIS: Sorry, do you mean money turnover?

MS. STEEL: Did you have a greater percentage of part-timers
       than John Nevison?
       A. I have not got the figures for John Nevison. I was not
in the store when John Nevison was there so, obviously,
I would not know what he did.

  Q. So you do not know what the situation was in the store
       then?
       A. All I know is when I went in there what I saw.

MR. MORRIS: You cannot compare your staffing levels with John
Nevison because you do not know the details of what -----
       A. No, I could not give a specific -- I never worked out
percentages and figures for something that had happened
earlier. I can see what it is physically -- what is there
at the time when I take over, but it was not really of
interest to me to work out how many part-timers or
full-timers he had three months earlier.

MR. JUSTICE BELL: Might I make a suggestion? It is fair enough
of you to suggest that Mr. Nevison is being attacked in
anticipation that Mr. Rampton might make the point that any
trouble under-18s working past 12.00 and so on is down to
one Floor Manager, so I anticipate that. But Mr. Roberts
has no experience of Mr. Nevison there. I have just looked
through his statement and I do not actually see, though
I may have missed it, any criticism of Mr. Nevison.

MR. MORRIS: Page 2 about the seventh line down: "In my view,
the store had clearly been suffering from poor management
       from the predecessor John Nevison".

MR. JUSTICE BELL: Fair enough, that may be so, but it does not
say John Nevison rather than anyone else has come before.
You have certain evidence from the witnesses who have been
called about a problem with under-18s which predates John
       Nevison.

  MR. MORRIS: Yes.

  MS. STEEL: Yes.

MR. JUSTICE BELL: I think you have done quite enough to attempt
to put any record straight with regard to John Nevison who
is not, in any event, a member of your team. I thought
your case in relation to this is that if you get a lot of
under-18s in the system, there is a tendency for some of
