                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

       during the break.

MR. JUSTICE BELL: Do your best to confirm her by some time
tomorrow. In any event, it seems to me that it would be
most sensible to read the Civil Evidence Act statements of
Lynval, which may involve a short argument; and I have
forgotten the name of the other one.

  MR. MORRIS: Mr. Ryan.

MR. JUSTICE BELL: Mr. Ryan -- before Miss Lamb is called, so
that they are actually in evidence by the time she goes
into the witness box, in case there is anything to be asked
of that. But that is a movable feast, and we can adjust
       that according to the timetable.

  MR. MORRIS: Yes.

  MR. JUSTICE BELL: Yes.

MS. STEEL: (To the witness) You said in your statement, in
paragraph 3 -- do you have that?
       A. Yes.

  Q. -- that when you arrived at the Heathrow: "....it was
immediately obvious that the basic problem with the
restaurant was one of understaffing. There were only about
60 crew members on the payroll, which was far too few for a
store of that size and volume." That is not true, is it?
       A. No, there was actually more. I did not have the
figures to hand. It was just a recollection.

  Q. So you just made it up?
       A. It was a recollection to the best of my knowledge at
       the time.

  Q. So, your memory is not very good, then, of this time?
       A. It was over a year and a half ago. I cannot remember
specific numbers for over a year and a half ago.

  Q. And you might be wrong about what hours people were
working, whether or not they got their breaks on time, all
       that kind of thing?
       A. I cannot remember specifics about everything, though.

  Q. This morning you said about the crew being transferred from
Uxbridge; that was five transfers. Were they full-time or
       part-time?
       A. Full-time.

  Q. They were full-time. You also said: "Anybody who came in
and asked for a job, we would interview them straightaway.
It was during the summer, so a lot of people were looking
       for jobs." Is that students?
       A. There may have been students in there. I am saying
       anybody.

  Q. But were quite a lot of them just looking for temporary
       jobs over the summer?
       A. Some may have been, some may not. I did not track it.
