                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

MR. MORRIS: Do you agree with Mr. Khazna?
       A. Sorry?

  Q. Do you agree with Mr. Khazna about what he said about this
being one of the methods -----?
       A. It is not a method that I have used.

  Q. But it would be an indication -- if you wanted to check,
this would be a document that would show, would it, when
performance reviews were due and what rises people were
       given?
       A. It is nothing that I have been instructed to use.

  Q. You have seen this kind of document before?
       A. I have seen it before, yes, but it is not the system
that I actually use or I have been instructed to use.

  Q. Presumably, the documents, you would verify they are
       accurate documents?
       A. I would assume so, yes.

MR. JUSTICE BELL: Do you agree with what Mr. Morris is putting
to you, that where it says, "The following rate charges
were proposed during the pay period", that the people who
are listed thereunder are all people who were eligible
during that period for a pay rise?
       A. I have never looked at that before in that respect, so
       to me it is new.

  Q. Do you know whether that is what it means or not?
       A. I do not know for a fact. It looks like it is, but
I do not know for a fact.

MR. MORRIS: If we look at the two columns under "new regular
rate", with the difference, we have -----

MR. RAMPTON: My Lord, now Mr. Morris is pursuing what one might
call submissions or comments rather than questions, because
the witness has said that it might be so; he does not know
that it is, and he has never used it for that purpose. So
it is not a valuable use of Mr. Roberts' time for him to
       answer questions about it.

MR. JUSTICE BELL: Can he really help you if he does not know?

MR. MORRIS: He presumed it was.

  MR. RAMPTON: No.

MR. MORRIS: Mr. Rampton is saying what the witness said. Let
us check what he said. "It looks like it is, but I do not
       know for a fact."

  MR. JUSTICE BELL: Yes.

MR. MORRIS: (To the witness) if we look at those two columns,
I will ask you a general question. I cannot read the names
in the left hand side, but, forgetting the starters --
because obviously they are on a new rate because they just
started that week, or that fortnight -- we have in the
