     3        A.  Yes.

     5   Q.   Out of 16?
     6        A.  You said you were not going to include new starters.

     8   Q.   Not counting the new starters, but out of 16 staff, but not
     9        starters.  So if we go to page 71 -----
    10        A.  Sorry, can you just hang on a second, please?

    12   Q.   Yes.
    13        A.  There are only five people who have not changed their
    14        rate.

    16   Q.   Does that indicate that -- as far as you can see, if you
    17        saw this document when you were at work, you would assume
    18        that meant that most people got their pay rise on time?
    19        A.  It tells me that five people did not.  It tells me
    20        also, or could tell me, that five people may have had their
    21        review done but did not actually earn a pay rise.

    23   Q.   Let us go to page 71.  We have here no starters; we have
    24        nought out of nine; and we have got the pay rise, on that
    25        page; and, over the page, I calculate nought out of -- none
    26        of them got a pay rise (this is the non-new starters), but
    27        one person got a "0 0".  That would be someone who actually
    28        scored nought on a pay review; is that correct?
    29        A.  No.  The people whose rate it says "new regular rate
    30        3.15", the difference is exactly the same, is that they did
    31        not actually get a pay rise.  Why it says zero, I do not
    32        know.

    34   MR. JUSTICE BELL:  You are positively saying that that is what
    35        the document -----
    36        A.  Their rate has not changed.

    38   Q.   Yes, I know.  Are you agreeing that that is actually what
    39        the document means -- positively agreeing?
    40        A.  I agree that the top one says that the rate has not
    41        changed.  Like I said, I have never used this as an
    42        indicator as to when somebody is due their performance
    43        review.

    45   MR. MORRIS:  Well, did you regularly, you know, the majority of
    46        people who had pay reviews, give them a nought pence pay
    47        rise?
    48        A.  Did I?

    50   Q.   When you were doing pay reviews under your management, did 
    51        you give people nought per cent pay rise most times -- the 
    52        vast majority of people who had pay reviews? 
    53        A.  I cannot recall every single performance review of
    54        every single person, no.  Some people would receive -- they
    55        would not receive a pay rise, yes.

    57   Q.   But it would not be the majority, would it, who had a
    58        performance review, who got nought pence pay rise?
    59        A.  I do not know whether it was the majority or minority.
    60        I do not know the figures.
