DAY 214
DAVID ROBERTS, Cross-examined:
past when he should not have been, and this is just a
computerised correction.

MR. MORRIS: Yes, that might be.

MR. JUSTICE BELL: But since they have had to correct those two
columns, they have to stuff something in the regular
column.

MR. MORRIS: Yes -- no, I agree with you.

MR. JUSTICE BELL: And they have put two noughts in.

MR. MORRIS: I think that is a very special case. That is just
an anomaly.

MR. JUSTICE BELL: What I am going to say is this, at the moment
you have made your point clear, you have had a modicum of
acceptance from McDonald's witnesses that it appears to me
what you say, and I will wait and hear if there is any
evidence which ---

MR. MORRIS: Which contradicts it.

MR. JUSTICE BELL: -- from actual knowledge gives an explanation
which is contrary to that. But I have now taken more time
than you would have done. I suggest you leave it there
with this witness because the rest is comment.

MR. MORRIS: Yes. Can I just point out then on page 76 only one
out of six seems to have had a pay review.

MR. JUSTICE BELL: We can look through them. I have already
whipped through them myself.

MR. MORRIS: OK. All right then, we will leave it at that.

MR. JUSTICE BELL: Did pay reviews fall behind in your first
period in all the hassle to get more people on the books?
A. They did, yes.

MR. MORRIS: People are entitled to a pay review, are they not,
at the appropriate time? That is part of McDonald's
official payment system?
A. That is correct. Any that are rewarded will be
backdated though.

Q. You said you put a stop to under 18 year-olds working past
12 o'clock as it was against Company policy. Did you
investigate who had been altering clock cards after you
found out that some of the Managers had been altering clock
cards?
A. I was told initially that it was happening, not
specifically who was doing it. You can check -- I did
check the clock cards to see whether the asterisk had
appeared, if something had been changed, but then some of
them would be legitimate mistakes the crew had made with
their clocking in and out. So, it was hard to
differentiate between the two, so I could not in detail
find out exactly who had done what and to who.
