                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

  Q. Yes. You said: "You can put systems in place whereby the
scheduling -- they would not be scheduled to an hour near
there, so it could not happen". So, that is 11 o'clock.
So why did you not just never schedule any under 18
       year-old past 11 o'clock?
       A. When I first got there or later on?

  Q. All the time.
       A. Well, later on they would not be scheduled. After
I took over, there is actually a scheduling package,
computer package; I put this schedule on to that so they
       would not be scheduled anyway.

MR. JUSTICE BELL: I thought you were pushing at an open door
here. I thought it had been accepted by Miss Moffatt and,
in fact, by Mr. Taylor that it took him some time before he
got enough people to be able to do it the way he wanted
       to.
       A. In my statement I say that people were working over.

  Q. That is why I asked him about the third sentence in
       paragraph 7.

MS. STEEL: I know that. The point is that he knew that it was
against Company policy and yet he was just carrying on with
       it.

  MR. JUSTICE BELL: Yes.

THE WITNESS: No, I was -- the people were scheduled until the
time before. If I was not there and a Manager insisted on
doing that, there is no way I could -- if I am not there,
       I do not know.

MS. STEEL: You said this morning that you scheduled them until
12 o'clock. That is asking for troubling, is it not?
       A. No, I was not actually asking for trouble.

MR. JUSTICE BELL: I am sorry, all this is obvious. If you keep
asking questions about it, you give the witness an
opportunity to back track. My understanding at the moment
is that this morning the witness accepted (and Miss Moffatt
did as well) that he had to carry on breaking Company
policy for a short period of time until he got the figures
up. If you want to ask questions so that the witness can
       reconsider that situation, go ahead.

MS. STEEL: For starters, the witness changed his answer half
way through this morning as well, because the initial
answer he gave was that he did schedule them until 12.00
and then when he thought about it twice he started bringing
       it back.

MR. JUSTICE BELL: No, I do not understand that.

THE WITNESS: No, I said that later on.

MR. JUSTICE BELL: He said "after a while".
