DAY 214
DAVID ROBERTS, Cross-examined:
THE WITNESS: Later on, after a while, when we had more people,
I could put in a system whereby they would be scheduled to
that time.

MS. STEEL: I know you said that later on. The point is that
his initial answer was just that he scheduled them until
12.00. The impression I got from Miss Moffatt's evidence
was that it carried on as well.

MR. JUSTICE BELL: I will have to check, because that was not
the impression I got from her, but there we are.

MS. STEEL (To the witness): The situation is, is it not, that
when you have got a problem in the store you can just
totally disregard the Company policy, and that is what
would happen?
A. In what respect?

Q. You just ignore it?
A. Which policies?

Q. The policy about not working past midnight.
A. No, I did not ignore it.

Q. Right. You have already admitted that you did, so .....

MR. RAMPTON: Well .....

MS. STEEL: Can I just ask, you said this morning that
breakfast started at 6 o'clock. I believe that a previous
witness said it started at 7.00. Did it change while you
were a Manager?
A. No.

Q. It has always been 6 o'clock?
A. Yes.

Q. Also just on that point, the 24 hour opening, that was
Christmas just gone, last month?
A. I do not know.

Q. You are not there any more. Do you know when the licence
was granted for 24 hour opening?
A. No, I do not. I was not there.

Q. I believe that it was while you were there, although you
did not make use of it?
A. No, it was not.

Q. It was not while you were there?
A. No.

Q. I am not asking about when you opened 24 hours. I am
asking about whether you had a licence to open if you
wanted to.
A. When I was working at Heathrow restaurant, we did not
have a licence to stay open 24 hours.

Q. If a store is understaffed people have to work faster and
harder, do they not?
