                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

big sort of room but in a -- it depends on the store. They
have changed the design over the years of what they do.

  Q. Sorry, the room has four walls, has it?
       A. Yes.

  Q. All these drive-thrus, they are fairly standard designs,
       are they not?
       A. There are different types. There is a new design, it
is called a Euro 195, which is different to the older
       ones. But they are similar.

  Q. But previously, before this Euro 195 came in -- when was
       that, last year?
       A. It was a couple of years ago.

  Q. -- they were all the same design?
       A. Similar.

  Q. Can I just ask you about Floor Managers and First and
Second Assistant Managers? Do they quite often not take
       their breaks?
       A. No, not really. They always take a break, so far as
       I know.

  Q. In your experience, they always take their breaks?
       A. They do not always necessarily take a full 45 minute
break. Like, for example, I do not. Some of them have 10,
so you have to clock out for it if they do have a break.
The Floor Managers, they have been around for a while,
originally had paid breaks anyway, so they do not need to
       clock out for them.

  Q. Just this business about: "If a Manager did not let crew
take a break, I would expect the Manager not to have a
       break as well"?
       A. That is the same.

  Q. If they are all taking short breaks, or whatever, then they
are not going to be particularly bothered if -----
       A. Like I said, all Managers have breaks. A Manager would
not go a shift without having a break. Therefore, if they
were to do that themselves, I would expect to give the same
       to the crew.

MR. MORRIS: You have said in paragraph 10 of your statement:
"Crew are encouraged to hustle. However, this is only the
case on the front counter on the drive-thru, never in the
kitchen where it would be dangerous"; yes?
       A. Yes, that is correct. I have never experienced hustle
       in the kitchen.

  Q. Has hustle now been dropped from the OCLs for kitchen work?
       A. I do not know.

  Q. You do not know?
       A. No. I am not sure if it was actually on there in the
       first place.

  Q. We have had evidence on that in the past.
