                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

       A. OK.

  Q. In paragraph 13, you said: "It is not necessary to turn the
grill off to change the Teflon, and does not normally
happen." Do you accept that it does sometimes happen, that
people would not turn their grill off first before
       they -----
       A. No, it never happens.

  Q. You said it does not normally happen.
       A. It would be turned off at night, because the grill is
turned off anyway, and that is when it would be changed.
I have never seen anybody turn off a grill in the middle of
the day to replace a Teflon.

  Q. But other times it could be changed when the grill is off?
       A. It can be changed when the grill is off at night when
       the store is closed.

  Q. That is when it is meant to be changed, at night?
       A. Yes. It can be changed when the grill is on.

  Q. But, in general, it is changed during the night?
       A. Yes. It is easier.

  Q. Right, OK. It is easier at night because you have more
time and the grill is off and it is easier to do?
       A. That is correct, yes.

  Q. The night closers that do -- I think it was you who
mentioned that, for example, is it Mr. Patil, did he do
       night closes?
       A. Yes.

  Q. He did a lot of premium hours. Presumably, did he choose
to do nights because he needed the money, he needed the
premium rate, and that is why he put in those -----
       A. I never asked him. I never asked him. I was not there
when he was employed, and I never asked him after I worked
       with him.

  Q. When you were Manager of the store, the premium rate was
       abolished, was it not?
       A. No, it was not, not as far as I know.

MR. JUSTICE BELL: Can someone give me the date for that?
I know we had it before.

  MR. MORRIS: 31.7.94.

MR. JUSTICE BELL: And it became just one rate apart from the
       regular rate?
       A. It might well have happened when I was there, but it
was not something I was aware of happening.

MR. MORRIS: Well, in the -----

MR. JUSTICE BELL: Just remind me. A time came -- and I cannot
remember now, I would have to look it up -- it then covered
evening, what had been evening time and premium time, or
