Day 214 - 01 02 96 - Page 64

                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

just the premium time; but there were two rates instead of
       three.

MR. MORRIS: Yes. If you look on page 81 in the Heathrow
documents -- I will just check it with the previous one --
and actually 77, also, which seems to be the earliest one
-- hold on a second. I am going from Mr. Rampton's
       figures on Mr. Beech's chart.

THE WITNESS: Even in 1993, they were the same.

MR. JUSTICE BELL: I thought it was much earlier than that.

  MR. MORRIS: Yes.

MR. RAMPTON: It is miles earlier; it is either late 80s or --
I am just looking at the memorandum at the moment, my Lord.

MR. MORRIS: I have it mixed up here.

MR. JUSTICE BELL: Your confusion is understandable, because
although the two rates became one, they seem to have kept
two separate columns but just put the same rate in there.

MR. MORRIS: I have completely got the wrong timing.

MR. JUSTICE BELL: It was a long time before, I think; and
whatever the rate was, it covered what had been evening
hours and had been premium hours; so you did not get more
on top for the 11 through the night.

MR. MORRIS: You just got the same rate as the evening rate.
Forget that question completely. I had a brilliant ambush
after that, but it did not work.

MR. JUSTICE BELL: Anyway, that was a false trail.

MR. MORRIS: Yes. We have nearly finished.

MS. STEEL: (To the witness) What hours did you usually work
       in the store?
       A. It depended. I do not have a set schedule that I do a
certain amount of hours. It depends.

  Q. It was just that I thought you said generally you were not
there at the end of Mr. Beech's shift?
       A. Yes; at the beginning, yes. When I take over a
restaurant, there are many things I need to get sorted out,
and most of that, it is easier if I do it from the morning
onwards, i.e. hiring and other things I need to do. So,
initially, unless I was going to work through the day and
night, I would not be able to do that; and then as time
goes on, the shifts that I work, I look at different parts
of the store and different day parts of the store, and that
       is when I work.

  Q. So, to start with, you were kind of working -----
       A.  8 to 5, that sort of thing.  That is an average;
sometimes earlier, sometimes later, but mostly sort of
       8 to 5.
