                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

       A. Sometimes -- it was -----

  Q. Or else to the back room?
       A. When I was there, they were not using the computer
properly, the ISP, whereas I was quite well acquainted with
it. What I preferred the Managers to do, and which they
did most of the time, was that they would just take the
bins round to the office, and, rather than write it all
down -- which is what they were doing originally -- we
could just enter it straight on to the computer. But at
the time I took over, yes, it was either back room or the
       one next to production.

  Q. The ISP is?
       A. Instore processor, instore computer.

MS. STEEL: If I could have five minutes? I think we have
finished, but I wanted to check.

  MR. JUSTICE BELL: Yes.

                         (Short Adjournment)

MS. STEEL: You said that you know that it did not happen that
crew were ever told to go on a break or go home. You
cannot possibly know what is going on all the time in your
       store, can you?
       A. No.

  Q. So it could have happened, you would accept?
       A. If I am not there, if I did not hear it, yes.

  Q. You also say that if the restaurant was busy, then it would
normally be only five people working in the kitchen. So
you are saying that the maximum number of people that
worked in the kitchen was five; yes?
       A. Unless you had trainees.

  Q. Unless you had trainees?
       A. Yes. The highest hour we would do -- although the
restaurant was very busy, it was spread throughout the
week, throughout the day. It was not, for example, like
Marble Arch or somewhere where you would have an incredibly
busy hour, where they would need a lot more people in the
kitchen. Ours was fairly consistent. You did not really
need that many people in the kitchen.

  Q. The maximum would be five, unless there were trainees?
       A. Yes, that is correct. If you had somebody who needed
to learn, then obviously you would put them in -----

  Q. With a "buddy"?
       A. With a "buddy", or if they had already had that, if
they just needed experience, they would just be put in
       there as an extra person.

  Q. So that would be five in the kitchens between 12 and 2,
which was the lunch hour. I know you are saying it is not
massively busy at other times, but that -----
       A. Yes.
