                                                                  DAY 214

                                           DAVID ROBERTS, Cross-examined:

  Q. Is it possible to generalise about the reasons why they
       went?
       A. The reasons were from they were actually dismissed for
a wide variety of reasons; some people resigned without
notice; there were -- the discipline in the store did
change and some crew did not actually like that, so they
left and went to the Feltham store.

  Q. The beginning of October, the 9th is near the beginning of
October, comes after the period when people like Mr. Beech
go back to college. Is that a factor in this or not,
       building up for December?
       A. It was an on-going hiring process anyway which I always
have in every store that I am at.

  Q. Roughly speaking, if you can remember -- I am not expecting
you to do what one might call Mr. Memory tests -- by what
time, by what period, date, roughly, very roughly, do you
feel that you had actually had enough people to run the
store as you would like to see it run?
       A. By December, we were fine. I mean, by October we had
enough people onwards, from then onwards. The exact
situation that I wanted to be in was January.

  Q. Right.

MR. JUSTICE BELL: By what time you had enough people?
       A. By October I had sufficient numbers.

  Q. By?
       A. October, to meet the requirements that I had set out on
the schedule of how many people I needed, that I could
actually do that and give everybody the hours they wanted
to, and then by January I was in a position whereby I could
       help other people as well.

MR. RAMPTON: Yes. Thank you Mr. Roberts.

MR. JUSTICE BELL: Thank you Mr. Roberts.

                       (The witness withdrew)

MR. JUSTICE BELL: So you want to get off?

MS. STEEL: There were a couple of things I wanted to bring up.
I do not know whether you have a copy of the notes I typed
up of the phone call with Kevin Harrison the other night?
I did put one up there or hand one up.

  MR. JUSTICE BELL: Yes.

MS. STEEL: The other things is, I wanted to raise about the
thing about the Shops Act because we had a letter from the
Plaintiffs yesterday. I do not know whether you have a
       copy?

MR. JUSTICE BELL: I have, yes. I read it through quickly last
       night.
