     2        list of witnesses.

     4   MS. STEEL:   Yes.  There is also if there is anything to be said
     5        about the Heathrow documents.

     7   MR. RAMPTON:  No, there is nothing to be said about the Heathrow
     8        documents.

    10   MR. JUSTICE BELL:  That is entirely up to Mr. Rampton.  I mean,
    11        if he does not give me an answer within a few days, I will
    12        raise it myself.

    14   MR. RAMPTON:  My Lord, I have not got an answer at the moment.
    15        The answer is being sought, I hope, as your Lordship
    16        speaks, and an answer will be forthcoming and I hope very
    17        shortly.  I do not have an answer at the moment so I cannot
    18        answer that.

    20   MR. JUSTICE BELL:  Does that mean all we have to do is consider
    21        the list of witnesses?

    23   MR. MORRIS:  Yes.

    25   MR. RAMPTON:  So far as I know, yes.

    27   MR. JUSTICE BELL:  I have a reason why I would rather dispose of
    28        that and then rise for good rather than take a break.  It
    29        will not take more than a few minutes.  It will only be a
    30        few minutes, anyway.

    32        What I would like to do is put a tick against those whom
    33        you definitely -- you really do intend to call and where
    34        there is a very good prospect of you being able call them.
    35        So I can tick Harriet Lamb and Mr. Logan.

    37   MR. MORRIS:  Yes.  Obviously Mr. Brett.  Mr. Patel is definitely
    38        untraceable, but rather than do a CA, just in case we have
    39        not -- I would rather wait until the end of the employment
    40         -- the completion of our employment case and then read it
    41        out as a Civil Evidence Act notice there and then just in
    42        case.  I have left messages for him to contact me so .....

    44        Jay Dunbar - if you remember, when I was asked to do a list
    45        of the employment witnesses, I think some time just after
    46        the beginning of term or before the end of last term,
    47        I said there was a couple of people outstanding who we were
    48        awaiting statements off.

    50   MR. JUSTICE BELL:  What was Mr. Dunbar on?  Is it Mr. Dunbar?

    52   MR. MORRIS:  He is an employment -- he is one of the ones I have 
    53        not given the name of or would not say which store it was,
    54        do you remember?  I did not want to give advance warning of
    55        which store he worked at until I had the statement off him
    56        and, apparently, he had done a statement some months ago
    57        and when I was preparing this list a couple of days ago, or
    58        seeing who was around, he said that he did not send it
    59        because he thought the case had finished.
