Day 236 - 17 04 96 - Page 5

                                                                  Day 236

whether he can call them or not, is within his control
anyway, until he knows about Mr. Monroe. I am not sure
Mr. Morris needs to know about Mr. Monroe to make a
decision in that, but however that may be, if he could be
given a decision at the beginning of next week, he knows
where he stands so far as Mr. Monroe's evidence is
       concerned.

MR. RAMPTON: By then at the latest, my Lord. Can I also say
this whilst I am standing up, and then I will sit down. I
have some progress reports to make to your Lordship, but
I will make those in due course.

MR. JUSTICE BELL: The next topic on my list was loose ends from
the discovery ruling. Is any of the information in
       relation to that?

MR. RAMPTON: That is a bit opaque. We have done what
Mr. Morris said we would do and I apologise to him for
having slighted his knowledge of computer science. We have
printed out not in the same form as it comes out, in a
different form, to the missing periods from Heathrow.

MR. JUSTICE BELL: Are from any loose ends in relation to the
       Heathrow documents?

MR. RAMPTON: Not now; I do not believe so.

MR. JUSTICE BELL: Is there anything you want to say on that Mr.
       Morris?

MR. MORRIS: We would obviously like to have them.

MR. RAMPTON: Of course. We are not going to keep them or
       ourselves.

MR. JUSTICE BELL: They can be handed over before the end of
       this week, can they?

MR. RAMPTON: Yes, my Lord. I think that is the only remaining
discovery matter, save for this. In your Lordship's ruling
on rainforest discovery, in relation to the area from which
Goias Carne gets its beef, what your Lordship said was
either we should pursue Mr. Morganti, or else elect to
submit an order for discovery. Mr. Morganti has said that
he is willing to provide as good a list as he can of where
Goias Carne gets its beef from, and he is in the process of
       doing that.

MR. JUSTICE BELL: When will arrive?

MR. RAMPTON: That I cannot say, but I hope -- it was in hand
last week and I know it is because I was in London and
I spoke to the American lawyers, and I know that it is in
hand. If it does not arrive, in your Lordship's view in
good time, then I will invite your Lordship to make the
order for discovery in any event.

  MR. JUSTICE BELL: Well ----
