Day 236 - 17 04 96 - Page 12

                                                                  Day 236

MR. MORRIS: He is -- we are awaiting confirmation but we are
fairly confident we will confirm that. I should know, or
certainly by the end of this week on that and the
Plaintiffs have kindly shifted Mr. Preston from that day so
       that Mr. Campbell can ----

MR. RAMPTON: I should add that Mr. Preston has also kept the
9th free just in case Dr. Campbell does not make it on that
       day.

MR. JUSTICE BELL: Yes. That is helpful.

MR. RAMPTON: He is not available after the 13th until some
later date perhaps, if absolutely necessary. He is not
       available on the 14th.

MR. MORRIS: Then Mr. Brett is scheduled for the 15th and I am
hoping to keep him there because he has been scheduled
about 8 times so far. No one is to take the blame for
that. So Mr. Olive hopefully at some stage that week as
       well.

MR. JUSTICE BELL: Then there are two aspects which occur to me,
one of which Ms. Steel may deal with in a moment, which is
the question of what she feels she needs to see at Barlow's
offices. We will put that on one side for the moment.

In fact, there are 3: Then there is the question of which
nutrition witnesses are to be called or recalled and Ms.
Steel kindly told Mr. Glen when she bumped into him,
I think you were with her, the result of the appeal.
I have not yet received the transcript of judgments and may
not do so for several weeks. So what I do not know is
whatever the result of the appeal, whether any comment was
made which might affect the witnesses. That is entirely a
matter for you. You were there.

  MR. MORRIS: Right.

MR. JUSTICE BELL: I would like you to tell me within the next
few days what your plans are for nutrition witnesses.
Mr. Rampton has to bring Mr. Fairgrieve back into the
witness box. You have to -- I say you have to -- bring
Professor Crawford back. He has to come back for further
cross-examination. Who else comes among the witnesses of
from whom I have statements? For the parties to decide
that, we must come to a decision about that fairly closely,
       fairly soon.

The other matter is the question of the other litigation
       you are involved in.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: I should say that this is subject to anything
you want to say to me, but having looked again at the scope
of the evidence which appears to me has to come, I really
think that the parties should be aiming at concluding all
the evidence in this case before the end of June. I know
