6 that step to protect yourself against any risk of running
7 out of time.

9 MR. MORRIS: Can I ask one thing on the question that you raise
10 there about the evidence closing? That at the end of all
11 the evidence, we be given some time to actually go over
12 checking that we have actually read out all of the Civil
13 Evidence Act matters, that we have called all our
14 witnesses, because although I believe we have done pretty
15 well an efficient scheduling over this trial, I am
16 concerned that it has been largely chaotic behind the
17 scenes. So we be given some time to `clean our house' up
18 at the very end.

20 MR. JUSTICE BELL: I would not have thought that would take very
21 long because what you have to do -- you need not worry
22 about your Civil Evidence Act witnesses because they do not
23 have to be read. If you put a valid notice on them,
24 I think it is probably safer if you actually list them as I
25 have asked before, but I would not have thought that would
26 take a very long time.

28 The other question is if you have you forgotten to call
29 someone if they are available to be called, I would that
30 thought that could be checked very quickly by looking
31 through the indexes to the pale blue bundles of any names
32 which have been added on. In my pale blue bundles I have
33 added the names of witnesses as you have served their
34 statement.

36 MS. STEEL: I do not know whether it is possible to borrow your
37 index because ours are not up to date?

39 MR. JUSTICE BELL: If need be, Mr. Glen will make a photocopy of
40 them.

44 MR. MORRIS: There was something, while we are on that subject,
45 and we are not under extreme pressure here, but you said
46 something before which I did not quite understand about, at
47 the end we will be asked something about when we are in the
48 witness box, or something: "Is there anybody further we
49 wish to call?" I did not understand. You mentioned that
50 before, in terms of the process at the end, when we
51 actually called ourselves.

53 MR. JUSTICE BELL: Yes. I do not think this is any more than a
54 formality. At a time when it appears that all the evidence
55 has been called on both sides, or it appears to me that it
56 has, since the plan is that you and Ms. Steel shall give
57 your evidence, effectively last, if you decide to give
58 evidence, I will ask Ms. Steel: "Do you wish to give
59 evidence?" And if she says: "Yes", then she will go to the
60 witness box and give her evidence. When she has completed
