12 So, as I said there, I want to make a statement about that,
13 but not just about that. About other matters which are in
14 the Plaintiffs' publication witnesses, which was your
15 suggestion.

17 Then on page 50, line 15, I just said:

19 "All this things are going to take some time.
20 That is all. So it is very helpful that the
21 publication witnesses come after the official
22 vacation because that gives time for doing those
23 things, but if they are brought forwards, then
24 we may need some time for preparation in any
25 event..."

27 and you then said you understand that and that we should do
28 our best to schedule the rainforest witnesses, or you might
29 be in a position where Mr. Rampton is asked to get on with
30 the publication witnesses.

32 Now, as Mr. Morris has pointed out, what Mr. Rampton said
33 this morning was not entirely correct about how there was
34 no witnesses scheduled for Thursday and Friday and that
35 they were thinking of calling their publication witnesses
36 then anyway to fill the gap because I thought that everyone
37 was well aware that the plan was that Mr. Monroe was going
38 to -- whilst originally he was coming on the Tuesday and
39 continuing on the Wednesday, because of Mr. Morris' case,
40 he was going to start on the Wednesday and might continue
41 to the Thursday, which just left Friday as a blank, because
42 we had not actually managed to find anybody for the
43 Friday. But I think considering that the job that has been
44 done with the rest of scheduling, I do not personally feel
45 that that should be used against us.

47 Now, as Mr. Morris said this morning, we had originally
48 scheduled Mr. Brett for the 18th, but when Mr. Monroe got
49 moved, we told him not to come because obviously there was
50 no point in getting him here if Mr. Monroe was going to
51 last all Thursday.

53 The Plaintiffs must have had an idea for quite some time
54 now that they were having problems getting hold of
55 Mr. Monroe and that they had doubts about whether or not he
56 was going to attend, but that has not been communicated to
57 us. I am not saying it is their fault Mr. Monroe has not
58 turned up, but I do not think that we should be put in a
59 difficult situation, through the failure of one of their
60 witnesses to attend.
