Day 236 - 17 04 96 - Page 31

                                                                  Day 236

       that.

If I can just say that one thing that has occurred to me is
that one of the reasons why I wanted to inspect the
original documents was exactly the point which was raised
by the Plaintiffs this morning. Which is that they do not,
it appears to me, that they have not kept the documents
which they say were handed out on those specific dates.
So, obviously, that goes to the issue of whether or not
       there was publication.

MR. RAMPTON: That is not right. I now know that we ----

MR. JUSTICE BELL: -- That would be a matter for
cross-examination, in any event, rather than averment on
       one side or the other.

MR. RAMPTON: We have found them.

MS. STEEL: The point I am making is that that the other side
keep saying, "What do you want to look at this for? You do
not need to do this. You do not need to do this or that."
They are not fighting our case for us; we are fighting it
for ourselves. Things that are not necessarily obviously
apparent to them may be apparent to us. So I do not think
that the case should be judged on what the Plaintiffs
think. Or the need for looking at documents should be
       judged on what they think.

The final thing I want to say is that apart from the five
files to read through, there are the videos to watch and if
you are considering Mr. Carroll giving evidence this week,
then obviously if we have tomorrow, then at least we might
be able to watch the videos and do some kind of inspection.

MR. JUSTICE BELL: If I did decide that I shall allow
Mr. Rampton to call Mr. Carroll, I think what I will do is
give you a choice of starting Mr. Carroll now; showing the
videos as he identifies each one, while he sits down in the
witness box, so you see them in court. Either side
starting just before the midday adjournment, or starting at
2 o'clock. Or taking that course, starting tomorrow
       morning.

Would there be any objection to Ms. Steel taking the videos
       home overnight?.

MS. STEEL: I have got a set.

MR. JUSTICE BELL: You have got copies, have you?

  MS. STEEL: Yes.

MR. RAMPTON: They also have all the files.

MR. JUSTICE BELL: , it may seem a painstaking way of doing it,
but it seems to me that if the witness is to refer to
videos, then let them be shown in open court which gives me
the opportunity of seeing them; the one I have seen before
again, and the others for the first time.
