                                                                  Day 236

asked him to produce whatever TEC1 is, you look at whatever
TEC1 is and then you can ask Mr. Carroll about it. You can
challenge, if there is a challenge, that he actually
received an original, of which that is a copy? Take
whatever course you wish in relation to your challenges in
cross-examination, but what you should be shown when I rise
is whatever TEC1 is, because the statement ----

MR. RAMPTON: My Lord, if it is the first ----

MR. JUSTICE BELL: In fact the photographs in TEC1. That is my
       error.

MR. RAMPTON: That is right, they are here.

MS. STEEL: TEC2 on page 34.

MR. RAMPTON: TEC2 is this in my hand, so far as I am aware
because your Lordship rightly says I can only speak for
        ----

MR. JUSTICE BELL: What the statement says is -- which
statement? Which leaflet? This is the leaflet which --
       sorry. Wait a minute.

MR. RAMPTON: It is in paragraph 12. It says "a copy of which
is attached to this statement marked TEC2".

MR. JUSTICE BELL: Ms. Steel and Mr. Morris, it seems to me,
should be shown is whatever TEC2 is.

MR. RAMPTON: To the best of my belief, it is that.

MR. JUSTICE BELL: They can look at that when I rise. All
I will say is that if that is, in fact, a photocopy of
something and if it is said that there is something is
available, then the something should be here.

  MR. RAMPTON: I quite agree.

MR. JUSTICE BELL: And the same applies to any TECs which are
       photographs.

  MR. RAMPTON: Yes.

MR. JUSTICE BELL: When do you --

MR. MORRIS: Can we just have a couple of minutes to think about
       our situation? (Pause).

MR. MORRIS: Right. We are prepared for him to be heard this
afternoon in-chief we would like to be able to start
cross-examination tomorrow morning, if that is OK. If, and
we would like to see all the originals that the Plaintiffs
have in court relevant to publication, we would like to
look at them over the lunch period. So if we could
possibly start a little bit later.

MR. JUSTICE BELL: I will rise now until quarter past 2. I
would like that to be done with Mrs. Brinley-Codd's
