Day 236 - 17 04 96 - Page 53

                                                                  Day 236

                                        TERENCE EDMUND CARROLL - EXAMINED

1 said about speaking loudly and I will try and remember
2 too. That label on the outside of the plastic envelope is
3 not, I think, in your handwriting; is that right?
4 A. No, it is not, my Lord.
     5
6 Q. You have already told us that the writing at the top of the
7 document is not your handwriting?
     8 A. No.
     9
10 Q. Can you extract the document from its envelope. Can you
11 tell us whether or not that, as far as you know, is one of
12 the leaflets collected on that date, 16th October 1989?
13 A. As far as I can tell it is, my Lord.
    14
15 Q. Thank you. We also have in court, I think, I will be
16 corrected if I am wrong, the originals now of all of
17 Mr. Carroll's exhibits. There is doubt about one of them,
18 which looks to me as though it is a photocopy but with
19 Mrs. Brinley-Codd's blue handwriting on it which is the one
20 for 21st May 1991 which she says is what she would have got
21 from McDonald's, but all the others are as gathered at the
22 time, I am instructed, or at least as received by her at
    23 the time.
    24
25 MR. JUSTICE BELL: Yes. We will adjourn now.
    26
27 MR. MORRIS: Can we clarify the situation through the court with
28 the original documents that we have asked for, the
29 originals of all the publication documents, to look at
30 overnight tonight and ask what is the situation is?
    31
32 MR. JUSTICE BELL: Which documents are you referring to?
    33
34 MR. MORRIS: All the originals of all the relevant documents on
35 publication, including the counterclaim file.
    36
37 MR. JUSTICE BELL: Those are the ones which you can go to
    38 Barlows to inspect.
    39
40 MR. MORRIS: We asked them 3 weeks ago to get them ready for
41 us. We said that we wanted to view them and then we asked
42 last night if they could be bought to court and we repeat
    43 that request today.
    44
45 MR. JUSTICE BELL: Where were you going to look at them?
    46
47 MR. MORRIS: We were going to take them home if they were here.
    48
49 MR. JUSTICE BELL: Not the original exhibits or documents.
    50
51 MS. STEEL: If we had been given the time, I would have gone to
52 Barlow's offices to look at them but we have not been given
    53 the time.
    54
55 MR. JUSTICE BELL: I dealt with that this morning. You can look
56 now at the TEC documents. You must start your
57 cross-examination at 10.30 in the morning. If you go to
58 Barlows in due course and look at any other documents, and
59 can demonstrate to me that you need to ask Mr. Carroll
60 further questions about any documents in the future, then

                                      53
