     4   MR. RAMPTON:  That is right, my Lord, exactly right.

     6   MR. JUSTICE BELL:  You can ask Mr. Carroll about that tomorrow
     7        because what Mr. Rampton has just said is his instructions
     8        which he is relating to me as a result of your inquiry.
     9        What I am concerned with ultimately is the evidence which
    10        is given from the witness box in this instance where we are
    11        not concerned with Civil Evidence Act Notices and the only
    12        function of the actual statements -- they are not
    13        affidavits; they are not capable of being evidence in
    14        themselves as an affidavit might be, or a statement might
    15        be if a Civil Evidence Act Notice had been applied to it.
    16        They are merely a form of notice to the other party of the
    17        evidence which it is anticipated that the maker of the
    18        statement will give in due course.
