Day 237 - 18 04 96 - Page 26

any legal action she should know about it.

  Q. So you were anticipating legal action at that time?
       A. I did not know.

  Q. You do not know; you just sent it to her on the off-chance
that they might have been thinking about it?
       A. Any demonstrations that we have information about or
came to our attention or there was correspondence, then
I almost automatically transfer to Mrs. Brinley-Codd.

  Q. Did you also blank out the parts on this document?
       A. No, I did not.

  Q. You did not. What was written there?

MR. RAMPTON: No, we cannot have that; it is blanked out by the
legal advisers on the ground of irrelevance.

MR. MORRIS: We are entitled to ask.

MS. STEEL: Was it about the weather, about you being out on the
picket and being interrupted by a phone call from your long
       lost aunt or what?
       A. Can I answer that question?

MR. JUSTICE BELL: No, just sit down for a moment and I will
       hear argument about it.

MR. RAMPTON: It was blanked out, my Lord, on the ground that it
was irrelevant. It had nothing to do with (and still does
not have anything to do with) the issues in this case,
namely, what was the character of the demonstration and
whether or not the Defendants, or either of them,
       distributed the words complained of.

MR. JUSTICE BELL: What do you say about that?

MS. STEEL: I mean, it is a report about a demonstration.
I cannot really see how, unless it is something like a
comment on the weather or being interrupted by his long
lost aunt phoning, it can be about anything else other than
       something that is relevant?

MR. RAMPTON: It has to do with the demonstration but not to do
with any issue in this case. The two things are not the
       same.

MS. STEEL: The nature of the demonstration is an issue in this
       case.

MR. RAMPTON: Bo it does not have to do with the nature of the
demonstration, the character of the demonstration, the
duration of the demonstration, anything that happened at
the demonstration, nor does it have anything to do with the
identification of Ms. Steel who in any case was there, as
       we know.

MR. MORRIS: Was it some indication of legal action?
