Day 237 - 18 04 96 - Page 47
MR. RAMPTON: I am not going to arrange anything until I am told
-----

MR. JUSTICE BELL: You had better tell me what the purpose of it
is anyway.

MS. STEEL: It is quite obvious what the purpose of it is. We
have pleaded that the Plaintiffs were participating in
distribution of leaflets and the leaflet complained of, and
the Plaintiffs are complaining about continuing
distribution of leaflets subsequent to the service of the
writ, which they are saying justifies them issuing leaflets
nationwide to all their stores and various press releases.
You know, it just puts a totally different light on it if
the fact is that these leaflets are being distributed by
their agents and it something that is pleaded.

MR. JUSTICE BELL: If you are saying that any of the people on
the video, for instance, are people you think are an
undercover person or someone you have not known for some
time, I suggest you start by doing that. I think the
original video should be produced because there is a point
of general principle, any party is entitled to see the
original of anything which is produced.

MR. RAMPTON: Of course.

MR. JUSTICE BELL: For all I know, you might hear something else
which is relevant, whether or not this is relevant, if you
hear the best possible sound track.

MR. RAMPTON: I am instructed this is the original.

MR. JUSTICE BELL: What I suggest you do is take it away -- that
is the original?

MR. RAMPTON: I am told it is, yes.

MS. STEEL: I mean, I want to solve this problem and I prefer to
solve it now. It might help if Mr. Nicholson (sic) stands
nearer to the television and the volume is turned down so
it is not distorted.

MR. JUSTICE BELL: Stand near the television, if you do not
mind, please, Mr. Nicholson (sic). Do not answer any
questions from there, but if you would be so kind as to
come and stand where you saw Mr. Hill standing a moment ago
and then put it at whatever level of volume you want, Ms.
Steel, and play it again. I am completely bailing out of
listening to this because my hearing is so indifferent that
I would not be able to tell anyway.

(The video tape was again played)

THE WITNESS: I do not recognize any voices.

MS. STEEL: No, that was not it. It is just after this.

(The witness again listened to the video recording)
