     1        matter so far as that is concerned, since on the second
     2        page one can see in the second last paragraph, which
     3        starts: "As part of this year's campaign London Greenpeace
     4        is organizing an anti-McDonald's fare on Saturday, 21st
     5        October".  We know that October 21st, 1989, was a Saturday
     6        and, therefore, at least we have got the right year for
     7        this document.  As your Lordship will see later on in the
     8        case, in any event, after issue of the writ, this form of
     9        the leaflet became a substantially different creature, of
    10        the short leaflet, I mean.

    12        Mr. Carroll, all I ask you to do is to have a glance at
    13        this.  I do not know whether the original was pink or
    14        white.  We will find out in due course.  Just have a glance
    15        at it and tell us, please, whether you recognize it from
    16        your observations on the 16th October, 1989?
    17        A.   This would have been similar to the ones that were
    18        handed out outside.

    25   MR. RAMPTON:   Yes.  He was an articled clerk at Barlow Lyde &
    26        Gilbert who has long since left for good reason or ill, and
    27        his full name was, I think, Bernardo de Viere(?), and his
    28        country of origin was the Argentine.  More than that, I am
    29        afraid, I cannot tell you, and you cannot answer that
    30        either, Mr. Carroll?
    31        A.   I am afraid I cannot.

    33   MS. STEEL:   Can I just -- I mean, this probably is not a
    34        question -- well, it is not a question for Mr. Carroll, but
    35        can I clarify whether it is said that this was handed by a
    36        protestor outside McDonald's, or whether -----

    38   MR. JUSTICE BELL:   Mr. Carroll, do you know anything about the
    39        writing on that?  Does that mean anything to you?
    40        A.   Nothing at all, my Lord.

    43        A.  The leaflet is one similar to those that were handed
    44        out outside McDonald's.  I do not know if that was one that
    45        was handed out outside McDonald's, or it was certainly
    46        similar to the ones handed out.  I do not recognize the
    47        writing and I do not recognize the written dates.

    49   MS. STEEL:   I just wondered if the Plaintiffs' solicitors knew
    50        whether or not -- when it says "handed" -- whether it was 
    51        passed on from McDonald's or passed by the protestor.

    53   MR. RAMPTON:   It says "outside".  I have no idea the answer to
    54        that and, if I had, I should not give it because I am not
    55        entitled to give evidence.  I have done that quite enough
    56        already.
