Day 237 - 18 04 96 - Page 58

you to pay particular attention to this page and those
paragraphs" so I can mark them up. I will not say any more
at this stage, because what I want to try and avoid, if
possible, is spending long parts of the day reading more
than it is necessary to read. I will read it all myself.
       So think about that, please.

       Apart from anything else -----

MR. MORRIS: Can I just say relating to that that the article
verified by Doctor Jim Nations, I am getting -- there is a
page that was badly photocopied; it was obscured -- page
17, I believe it was -- on the version that was printed in
the environment magazine. I am trying to get the original
article in any case, which was in NVO, but I am trying to
get the page, the part of the page that is obscured on page
17 and also trying to get a copy of the map. I have
contacted the person who made the map. Remember the map
that showed deforestation, the question of deforestation in
Central America? I have contacted the person who made the
map for that publication and he has sent me in the post a
       copy.

MR. JUSTICE BELL: Very well. Thank you. Apart from anything
else, I ask that your environment witnesses be put in at
one a day rather than wider apart. To ensure that we get
through them comfortably within the day, if we possibly
can, it would be a kindness to them not to have them
standing in the witness box for a long time while long
statements are read or articles which are incorporated in
their statement. It may not particularly apply to the ones
you have got Monday, Tuesday and Wednesday, but even with
those, particularly, perhaps, Mr. Secret and Miss Watson --
Miss Watson who has got a number of articles and things
       attached to her statement ---

  MR. MORRIS: Yes.

MR. JUSTICE BELL: -- it is not a kindness to them if they have
to stand in the witness box while someone reads at them for
a long period and then find that that leaves insufficient
time for cross-examination, so they have got to come back
the following day when it might be avoided, or even they
are here longer during the day than is necessary. I am
only saying this so you can give a bit of thought to it
before they come into the witness box.

The other matter is this, and it relates back to the
argument we had yesterday and what Ms. Steel said about
inspection of documents in the possession of Barlow Lyde &
Gilbert. There is a day when we are not in court
tomorrow. It looks as if there may be a day, mainly
Thursday of next week, when we are not in court. There are
preparation days, as they have presently been designated,
on Tuesday and Wednesday of the week after and I do urge
you to make as prompt arrangements as you can to see
whatever it is you would like to see in relation to that
documentation. I am not going to interfere in it any more,
but I think it would help the future conduct of the case if
you do it as soon as you can.
