Day 249 - 14 May 96 - Page 42

  Q. Do you remember when that was?
       A. I am afraid I do not.

  Q. Was it before or after the writs were served, do you
       remember?
       A. After.

  Q. After the writs were served?
       A. Yes.

  Q. Right.
       A. I would have thought after 1990.

  Q. OK.
       A. Sorry, after 1991; whichever the date of the initial
court hearing was, it would be after that.

  Q. Right. The writs were served in 1990?
       A. The writs were served in 1990; the court hearing was,
       I think, early 1991.

  Q. Which court hearing?
       A. The one in which your three colleagues .....

  Q. In January 1991?
       A. Yes, I think it was January '91.

  Q. Right, and you had not thrown out half your files in the
       meantime?
       A. No, I have not thrown out anything and I would be
       surprised if Terry Carroll had.

  Q. He was under your instruction not to?
       A. He was under my instructions not to, most certainly.

  Q. OK. When exactly was it that you decided to take some steps
to investigate this leaflet and try and put a stop to it?
I think you said it was after it came into your possession
       in 1987?
       A. Yes. I mean, I was conscious of London Greenpeace way
back in 199 -- 1984, but apart from writing to or
instructing Barlows to write to the organisation I had not
really taken any tremendous amount of interest in it at all
until 1987 when that leaflet, or variations of it, began to
proliferate around the country, around Europe, around the
world. I made my first -- well, my only visit to 5
Caledonian Road I believe in 1987; I believe it would be
1987 when I first went there.

MR. JUSTICE BELL: Can you just pause a moment?
       A. Yes, my Lord.

  Q. I was going to ask you when the visit to the book shop in 5
Caledonian Road was, because if you look at your first
statement you deal with a copy of the leaflet complained of
first coming into your possession on 16th October, 1987?
       A. Yes.

  Q. Then in paragraph 5 you speak of what you propose to do and
then paragraph 6 you say you conducted your own inquiries
