Australian test cases

The Australian Competition and Consumer Commission is seeking test cases to bring representative actions against corporations which deal unconscionably with small business under a new section in the Trade Practices Act. The provisions are designed specifically to give small businesses remedies against franchisors and retail landlords who impose oppressive terms in business deals, particularly where there is an imbalance in bargaining power, terms in the contract unnecessary to protect the interests of the stronger party and where the stronger party does not adequately disclose or explain the documentation.
