It seems a strange coincidence that 6,000 people all decided to 'scam' McDonald's at exactly the same time. That alone shows that they may well have a valid argument. McDonalds promised prizes to anyone who matched game cards that they had received this year - lots of people got matching cards this year - McDonalds refused to honour their promise. Sounds like a strong case to me. Your dissent is based on whether or not all those people honestly obtained last year's cards or whether they deliberately used them - no doubt a few people try that trick each year but not this many people at the same time, many of whom have signed statutory declarations saying that they were given the 1998 cards this year. It's going to be hard for Maccas to stop the court from at least giving these people an equitable remedy. McDonalds should have seen that this could happen and clearly put the year on both sides of every card printed, not just change the colour on one side or add a small logo. How were customers or even inexperienced staff supposed to know what year's competition they were from. To cut a long story short, the McDonalds claimants have a few valid points too, and it will be interesting to see what the court decides. None.
