You need lots of information

The first thing you need to know is what sort of food poisoning your friend had (i.e. salmonella). That's because some types of poisoning take 24 hours to manifest, thus taking McDonald's out of the loop. Your suit will be dificult to prove without lots of this sort of information, but it's possible McDonald's will simply open their checkbook to avoid the hassle
