Day 021 - 29 Jul 94 - Page 33

1 A. On the whole, it would be valuable to know why any
particular course of action is being recommended, yes.
     2
         Q. In its instore nutritional leaflet, does McDonald's
3 anywhere mention the links between a diet high -- between
diet and heart disease, for example?
4 A. I would have to look at those.

5 Q. Shall we look at the nutrition guide?

6 MR. JUSTICE BELL: Do you have to put it to this witness or can
we just look and read it ourselves? If there is something
7 which you must put to the witness, then I understand. But
if it is something which I can just read for myself and
8 you can comment on, then there is no advantage in getting
              Professor Wheelock's answer to it.
     9
MS. STEEL: OK. I am not sure where that leads me.
    10
MR. JUSTICE BELL: If you tell me the point you are aiming at,
11 then I may be able to form a view on whether it is
productive to ask Professor Wheelock about it.
    12
         MS. STEEL: No.
    13
MR. JUSTICE BELL: It is common sense that it is only right to
14 give at least a balanced picture. Maybe you cannot give
the whole picture in that you cannot cross every last T
15 and dot every I, but you have to give a balanced picture.
That I would understand. The next thing you might ask me
16 to do in due course is to look at a particular document
and suggest to me that that does not give a balanced
17 picture. It has missed some vital ingredient out. But we
have been through quite a lot of that and I do not think
18 Professor Wheelock is going to help my decision on it.

19 MS. STEEL: OK. I can just bring that up myself, yes?

20 MR. JUSTICE BELL: Yes. Take it up in argument later or with
any witness of your own, if you wish.
    21
         MS. STEEL: Okay.
    22
MR. JUSTICE BELL: Let me ask you. What do you think you have
23 to cover with Professor Wheelock now?

24 MS. STEEL: There is not masses left.

25 MR. JUSTICE BELL: Pick another topic and we will do that and
then we will have our break.
    26
MS. STEEL: I am just trying to see what I can fit in before
27 lunch. There are a couple of points I missed out.
Physical bulk of food helps to control appetite, does it
    28 not?
              A. Yes, fair comment.
    29
         Q. And a concentrated form of energy such as fat would have a
    30 lower bulk?
              A. It would indeed.
