Day 111 - 30 Mar 95 - Page 24

There is another point I would like to make before Ms. Hovi
resumes: Quite some time has been taken up in this court
by saying what some third party of the proceedings thought
of this or that, be it some regulatory body, or some
government ministry, or someone outside the case altogether
who might be thought to be in a position of some authority
and able to judge these things.

Do remember at the end of the day that that may help me, it
may not. I have to form my own view. You have actually got
in the witness box at the moment someone who you are hoping
can actually give evidence of factual and various matters
from which you are hoping I will accept and on the basis of
which, if I accept it, you are asking me to draw various
conclusions. I hope it does not sound conceited if I say,
at the end of the day, I have to back my own judgment,
whatever MAFF's judgment or a regulatory body's judgment
       may be.

To give you an example, when you were going through the ITC
Code, there is a regulatory body, you were inviting me
there, and I will have to consider it, whether the ITC Code
said what I make of advertising standards to children and
so on. So do not forget that what the Ministry thinks, or
a regulatory body thinks, might give some guidance to me,
but it is my judgment on the evidence of fact which is the
       bottom line.

I would concentrate on getting your factual evidence out of
       Ms. Hovi?

MR. MORRIS (To the witness): If you look at the floor plan,
where on the line -- we have looked at this before so
people are pretty on top of what is actually going on at
Jarretts -- could you just identify the first area that you
       would be concerned about?
       A. Well, the first area that I would be concerned about is
one of the points on my statement which is the separation
of "clean" and the "dirty" side. Basically, we consider
that the lairage and anything outside the abattoir is the
dirty side of the abattoir and the abattoir gets cleaner
the further on you get on it. But, basically, as soon as
the evisceration starts, we are talking about the "clean"
       side of abattoir.

The first point where I would want to look at is where you
enter the slaughterhouse, the little door -- I do not know
if everybody is familiar of where the office block is?

  Q. No.
       A. Which is at the bottom of the picture. You can see
       some steps?

  Q. Yes?
       A. On the left-hand side. That is the office block. From
the office block, there is an entrance to the slaughter
hall, this empty area here which used to be the pig
slaughter hall which is not used any more. This is the
entrance where all the workmen and anybody who enters the
slaughterhouse, the meat inspectors, the veterinary
