2 A. Boy! You are asking -- I am not an Operations guy.
3 I do not deal with these things every day. I have not
4 looked at one of these for sometime. I do not really feel
5 competent to get into this.

7 MR. JUSTICE BELL: When did you last look at one, Mr. Stein,
8 very approximately?
9 A. Maybe 10 years ago, my Lord -- maybe more. It would be
10 when I was operating stores.

12 MS. STEEL: So can you just explain the procedure with
13 observation check lists in the USA, fairly briefly?
14 A. OK. There are the things you want a beginner to know
15 how to do. Then they rise up to the next level of
16 proficiency and that would be at the intermediate level.
17 Then the other items would be at a higher proficiency
18 level.

20 Q. On the observation check lists in America, are crew marked
21 on selling up and whether or not they are smiling?
22 A. I really do not recall.

27 Q. Is it only when the crew reach the higher proficiency level
28 that they are allowed to work a station on their own or
29 what?
30 A. No, no, what it is is generally as beginners they would
31 have what I would call a "buddy". I do not know what --
32 how the English do it here. Has that term been used?

35 A. OK. They have a buddy that usually works for them as a
36 beginner. In order for that buddy to be removed, generally
37 speaking, the person has to have arrived at that first
38 level.

40 MS. STEEL: Once they pass the first OC, as you call them, they
41 can do it on their own?
42 A. They can, but they may not be the most proficient --
43 they would not be the most proficient.

45 Q. They would not be as fast as -----
46 A. They would not do all the steps as accurately as they
47 should.

49 Q. They might make a burger a bit messy compared to -----
50 A. Yes, it may not be as pretty, kind of thing, as you
51 would like it to be.

53 Q. Just one question: I know you have said health and safety
54 is not your department, but in the claims made by employees
55 in 1994 there were five cases of people getting frost bite
56 or claiming frost bite. Do you know how they got frost
57 bite while working at McDonald's?
58 A. I have never seen an instance of frost bite. You are
59 telling me something I am not aware of.
