Day 080 - 30 Jan 95 - Page 51

MS. STEEL: They are in subtab 3 behind Mr. Walker's statement.

MR. RAMPTON: My Lord, the problem with the other ones we handed
over the other day is that though the Defendants made
copies for themselves, so far as I know they have not made
copies for us, so there are only the originals.

MS. STEEL: Mr. Rampton is wrong actually.

MR. RAMPTON: That is a relief. It may be unique but it is a
relief.

MS. STEEL: I have numbered our pages but the ones Mr. Walker
has are not numbered. We will have to refer to the date.

MR. JUSTICE BELL: What I suggest is you put yours at the end of
tab 3 behind the ones we have already got.

MS. STEEL: OK. Basically there are a couple of things that
I wanted to ask about. On the document that is dated 11th
January which is page 6 on the ones we have ----

MR. RAMPTON: My Lord, it may be better if Mr. Walker has the
photocopies.

MR. JUSTICE BELL: Why does he not have, as Mr. Rampton is
suggesting, the photocopies and then he can identify the
original if he needs to look at that.

THE WITNESS: Page?

MS. STEEL: Page 6.
A. Yes.

Q. It says there "30 tonnes of Brazilian beef"?
A. Yes.

Q. Is that the total amount that was ordered?
A. On that particular order, yes. Each time you order
something for a period you will issue an order such as this
and a purchase document. You can see, I mean, although it
is under "quantity" you can see it does not mean that. "(3
x 10)" that means it has to come in three 10 tonne loads.

Q. So if this was ordered on the -- this was ordered on 4th
January 1984, was it?
A. Yes.

Q. So when would you expect to receive that?
A. Well, delivery 10th/11th January 1984.

Q. You would expect it to be delivered on 10th January?
A. Yes. If I could help you. Are you thinking that it
had to come all the way from Brazil because it would have
come out of bond?

MR. JUSTICE BELL: Where was it?
A. It was in bond by then, sir. It would be held in bond
by Weddles.
