Day 145 - 29 Jun 95 - Page 33

MR. JUSTICE BELL: Leave that -----

MR. MORRIS: -- which is a complete non sequitur.

MR. JUSTICE BELL: You have opened the ground in relation to
that. Leave it for argument in due course.

MS. STEEL: Can I just ask a few questions about OCLs?
       A. Excuse me?

  Q. OCLs, Observation Check Lists?
       A. OK.

  Q. Does passing an OCL mean that someone is competent in this
       area?
       A. OK. I call them, Observation Check Lists, OCs.
Obviously "OCL" must be a British term. There are various
levels of check lists, if you will. There is the beginner,
there is the in-between person and there is the advanced
person who really can do it all in an extremely fine
       fashion.

  Q. So do you have three different forms then for that?
       A. Yes, there are three different levels.

  Q. Right.
       A. Let me suggest this. When I operated stores, I had
three different forms. I cannot with certainty tell you
there are three different forms today. I know there are
three different levels. They may have incorporated all in
the same form and you just use the right part of the form,
so I do not want you suddenly to thrust some form in front
of me and say: "Ah, huh".

  Q. No, I was going to ask you about a UK form because I do not
think any American forms have been disclosed. It is in the
Defendants' list of documents, bundle 4, which is one of
       the blue ones.
       A. Yes, I have the book. Which tab?

  Q. It is 117, but it is actually easier if you turn to 118 and
then go four pages from the back.
       A. My Lord, I think I have got a problem. I do not think
I have the right book then.

  Q. It is only tagged as "18".
       A. OK.

  Q. If you go into 117 from that but four pages from the back,
there should be an observation check list for fries?
       A. OK.

  Q. In the USA are your observation check lists similar or the
       same?
       A. This has to be a British thing.

  Q. Yes, I know it is a British one.
       A. Ours -- boy -- I have not looked at one of these for a
while. Ours appear to be different.
