Day 080 - 30 Jan 95 - Page 48

       I did not know -----

MR. JUSTICE BELL: Whatever your confusion is, what is the point
       you are after?

MR. MORRIS: Well, if the Plaintiffs wish to rely on it as a UK
       document -----

MR. RAMPTON: No, my Lord. It is there now because Mr. Walker
found it in his file, as I think was explained at the
time. It did not come from McDonald's. It is an old
specification. It appears to originate in the United
States. The significance of it that far is that it has a
prohibition against imported beef dated from 1978/79, which
obviously does not apply to this country. That is its
       significance.

THE WITNESS: I think I said that, did I not, a few days ago?

MR. MORRIS: Yes, but it is headed "England".

MR. JUSTICE BELL: We do not want to go back on the imported
beef side. What I am asking is, is there another point in
relation to food poisoning or rearing and slaughter which
you are after there, or are you just enquiring about it?
Obviously, an enquiring mind is generally thought to be a
good thing, but we need to know that we are enquiring about
       something which is in point.

MR. MORRIS: We are obviously finishing up bits and pieces now.

MR. JUSTICE BELL: Yes. I am trying to help you by finding what
the point is, because Mr. Walker may be able to help you
one way or another then, you see.

MR. MORRIS: I will move on from that particular document.

MR. JUSTICE BELL: We will have a break but I will not go to the
       formality of leaving court. (Pause).

MS. STEEL: Have you got your statement there? Is that the
       right bundle?

  MR. JUSTICE BELL: Yellow IX.

MS. STEEL: The raw material specifications that are at the
Appendix 2, this is just a query really, we were given
another copy, a faxed copy, the other day which appears to
be slightly different. I was wondering whether you know if
there have been any changes to this specification since
1991 without it actually being a completely new document?

MR. JUSTICE BELL: The Addendum about E.coli was 1991 or 1992.
Are you aware of any other ----
       A. No, I am not.

  Q. --- amendments to that specification?
       A. I am not aware of any. There are two in here and I was
just seeing if I could spot any difference quickly, sir.
